End User License Agreement

Terms of Service: To use the Eight Bam iOS Apps you must accept Eight Bam LLC’s Terms of Service listed here.

Parties: This End User License Agreement is between you and Eight Bam LLC only, and not Apple, Inc. EightBam LLC, not Apple, is solely responsible for the Eight Bam iOS Apps and their content.

 

Limited License: Eight Bam LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the Eight Bam iOS Apps for your personal, non-commercial purposes. You may only use the Eight Bam iOS Apps on an iPhone, iPod Touch, iPad, or other Apple device that you own or control and as permitted by the Apple App Store Terms of Service.

 

Maintenance and Support: Eight Bam LLC does not guarantee any maintenance or support for our iOS Apps.  Maintenance and support are provided when available. To the extent that any maintenance or support is required by applicable law, Eight Bam LLC, not Apple, shall be obligated to furnish any such maintenance or support.

 

Warranty: The Eight Bam iOS Apps are provided on an "as is" basis. As such, Eight Bam LLC disclaims all warranties about the Eight Bam iOS Apps to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Eight Bam LLC, not Apple, shall be solely responsible for such warranty.

 

Product Claims: Eight Bam LLC does not make any warranties concerning the Eight Bam iOS Apps.  To the extent you have any claim arising from or related to your use of the Eight Bam iOS apps, Eight Bam LLC not Apple is responsible for addressing any such claims which may include but are not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

 

Third Party Intellectual Property Claims: Eight Bam LLC shall not be obligated to indemnify or defend your with respect to any third party claim arising out of or relating to Eight Bam iOS Apps. To the extent Eight Bam LLC is required to provide indemnification by applicable law, Eight Bam LLC, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Eight Bam iOS Apps or your use of it infringes any third party intellectual property right.

 

Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

 

Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using this Application.  Your right to use this Application will terminate immediately if you violate any provision of this License Agreement.  The party providing your mobile OS has no obligation whatsoever to furnish any maintenance and support services with respect to this Application.

 

Third Party Beneficiary: Your mobile OS is a third party beneficiary of this License Agreement, and, upon your acceptance, such third party beneficiary will have the right (and will be deemed to have accepted the right) to enforce this agreement against you.

 

Miscellaneous: This Agreement may only be modified in writing by authorized representatives of the parties.  All notices required to authorized under this Agreement must be in writing and shall be send as applicable, to the legal department or to Eight Bam LLC, Attn: Legal, 638 Lindero Canyon Road #254 Oak Park CA 91377 USA.  Waiver or terms of excuse or breach must be in writing and shall not constitute subsequent consent, waiver or excuse.
